01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Shockara, a brand of The Nelson M Group LLC ("Shockara," "we," "us"). They govern your use of shockara.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Anyone who does not agree to these Terms must stop using the Services.

02What Shockara is, and is not

Shockara is an information service. We publish general, plain-language information about how insurance works, how to read a policy, and what tends to affect insurance costs, and let visitors opt in to related updates. We do not sell insurance, give quotes, rates, or price estimates, match people with agents or insurers, or refer people to providers, and we never share your details with agents, insurers, or other partners.

• Decisions about your insurance are yours. Reading our content does not obligate you to do anything.
• Your own insurer or agent, not Shockara, explains the terms, limits, exclusions, and costs of any policy, and is responsible for your coverage.
• Costs, coverage, and savings vary by person, plan, and location. We never guarantee that you will save any amount, qualify for any coverage or discount, or get any particular result.

03Eligibility

You need to be 18 or older, located in the United States, and able to form a binding contract before using the Services, and the information you submit must be your own or that of a person who authorized you to submit it.

04Your information and accuracy

You agree to give accurate and current information and to update it if it changes. You may only provide a mobile number that you own or are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

You agree, if you opt in, to receive email from us and, only for the boxes you check, automated text messages as set out in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. • STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 888-669-3681.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

You must not: (a) enter false or misleading details, or another person's details; (b) use the Services for anything unlawful, fraudulent, or abusive; (c) interfere with the Services or try to gain access you are not allowed; (d) submit forms with bots or other automated tools; (e) copy, scrape, or resell our content without our permission; or (f) pretend to be someone else. We may suspend or end your access if you do any of these.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for instance state insurance departments, consumer groups, or insurers) are operated by third parties. We do not endorse any product, plan, or provider, and we are not responsible for what those third parties do, publish, or deliver. Your relationship with an insurer or agent is between you and them.

09Intellectual property

The Services, including the Shockara name, logo, text, graphics, and design, are held by us or our licensors and are protected by intellectual property laws. We give you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial viewing and use of the Services. Photos on the Site carry their own free-use licenses.

10Disclaimers

The services and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, like implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered or delivered on time.

Shockara does not provide insurance, legal, or financial advice, and makes no representation about any policy, coverage, price, savings amount, or claim outcome.

11Limitation of liability

Where the law permits, Shockara and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any insurance decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Certain jurisdictions do not permit some limitations, so part of the above may not apply to you. These Terms do not limit any liability that the law does not allow to be limited.

12Indemnification

You will indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel for any claims, damages, and expenses, including appropriate attorneys' fees, resulting from your violation of these Terms, misuse of the Services, or provision of a phone number or other information you were not authorized to give.

13Disputes, governing law, and arbitration

Informal resolution first. Before filing a claim, please reach out to us at [email protected] and give us 30 days to try to resolve it.

Binding arbitration. Small-claims matters and claims for injunctive relief against intellectual-property misuse are excluded. Any other dispute between you and Shockara or The Nelson M Group LLC that arises out of or relates to these Terms or the Services will be settled by final, binding, individual arbitration run by the American Arbitration Association under its Consumer Arbitration Rules. You select whether the arbitration takes place in your county of residence or by video or phone. The arbitrator can grant the same individual relief a court could, and any court of competent jurisdiction may enter judgment on the award.

Class-action waiver. You and Shockara each waive, to the extent the law permits, any right to bring claims as a plaintiff or class member in a class, collective, or representative action; claims can be brought on an individual basis only.

Opt-out. You can opt out of arbitration within 30 days of your first acceptance of these Terms by emailing [email protected] and state "Arbitration Opt-Out" in the subject line, along with your name and mobile number.

Governing law. The laws of the state where The Nelson M Group LLC has its principal place of business, together with the Federal Arbitration Act, govern these Terms, without regard to conflict-of-law rules. Subject to the arbitration clause, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. We may suspend or terminate access at our discretion, including for violations of these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, indemnification, and disputes) will survive termination.

15Changes

From time to time we may update these Terms and will post the update with a new "Last updated" date. By continuing to use the Services after the effective date you accept the updated Terms. Notice of material updates will be provided where required by law.

16General

You and we agree that these Terms, together with the Privacy Policy and SMS Terms, are the complete agreement on this subject. If any part cannot be enforced, the rest stays in effect. A waiver only occurs if we say so; failing to enforce is not one. You may not assign these Terms without consent, and we may assign them in a merger or sale.
